Attorney Cynthia assisted a client with their application for employment authorization. After a delay in their asylum case, the client’s initial application for employment authorization was denied. When an asylum applicant “causes a delay” to their case, USCIS can stop their “asylum clock” to accumulate the requisite 180 days to qualify for employment authorization. Attorney Cynthia disputed the circumstances for which the “asylum clock” was stopped. She was able to successfully advocate for the client’s employment authorization clock to be re-started and count back the lost time. The client’s application for employment authorization was approved in one week!
