I-751 Removal of Conditions
Spouses of United States citizens who obtain permanent resident status based on marriage that is less than two years old are issued conditional permanent resident status valid for two (2) years. Such conditional permanent residents must apply to remove the conditions on their permanent resident status before the temporary, two-year permanent resident status expires. In general, the I-751 Petition to Remove Conditions on Residence must be submitted for processing to the immigration service during the ninety (90) day window before the two-year Permanent Resident Card expires. The general purpose of the process is for the applicant to prove that the parties entered the marriage in good faith. If the Petition to Remove Conditions on Residence is not submitted for processing timely, USCIS may automatically terminate the foreign national spouse’s status and issue you a Notice to Appear (NTA).
