Attorney Michael and his staff were retained to work on an adjustment of status application for a French citizen who had married his U.S. citizen spouse. The application was submitted for processing to USCIS in late 2021. The usual course of action for marriage-based adjustment of status applications is for the file to be transferred to the local USCIS office, which schedules the applicant for a face-to-face interview with an USCIS officer. In this particular case, USCIS approved the I-130 petition and the I-485 adjustment of status application without an interview. Although this is uncommon, it can happen when the application contains sufficient documents and information for the adjudicating officer to believe that the marriage is bona fide. The (happy) clients were delighted to be able to avoid the inconvenience of the physical interview.
